Alternative Fee Arrangements

The alternative fee arrangements (AFAs) have been the cause of much debate in the legal community during the past several years. Some law firms and attorneys have been very vocal proponents of implementing them or entirely switching to AFAs whereas others, who seem to be the majority, still feel uncertain if AFAs will help their bottom line or reduce their profitability.

Our goal with this comprehensive article is to explain exactly what AFAs are, and what AFAs are not. Also, we will give an overview of the main types used, as well as the examples of law firms that have successfully implemented AFAs in practice.

What Does an Alternative Fee Arrangement Mean?

According to the American Bar Association:

AFAs are not about charging more than what an hourly rate might be — they are about charging an appropriate fee based on what value the client receives and how that client perceives value. Alternative billing should be based on what is fair and reasonable both to the client and the lawyer. Keeping track of time should be the lawyer’s measure of cost, not necessarily a measure of the value he or she is providing the clients in their legal needs.”

On the other hand, AFAs are also not about charging less than the hourly equivalent. If a client perceives a greater value for you finishing a work in one hour, than, say in 3 hours, who is to say your urgent work should not be priced higher than what would you ordinary price for the 3 hrs of work?StrasbourgHumanRightsCt

Now I do even more advocate for such alternatives, based on the ordeal my family and I were put through by unscrupulous attorneys unworthy of practicing in this so dignified profession.”

For the last 27 years of my professional career I have been deeply involved with matters of human rights. When it was me who was put in a situation of inhumane torture and treatment, due to undue influence and corruption in courts of law, and said situation affected my child and I, I had to use my professional formation to survive, recuperate my freedom, and bring justice about, in my case by US Federal and International Courts.
I had to come to terms and expose the travesty of justice, I was put through, to raise awareness and fight to prevent its repetition. My attorney license despite of my assailants is without blemish. International Organizations have praised my fight and courage. Drafting Laws and Amendments to international treaties to include transparency, accountability, and redress is imperative.

But these demanded to start by telling the atrocity done to my child and I. Due to corruption of former judges and politicians, who I am sure are reading my profile, I was subjected to illegal prosecution, a wrongful conviction, followed by illegal imprisonment, cruel and unusual punishment, torture, and human rights abuses contrary to International Law.

The only way I could contribute to terminate those abuses endured by me and advancing the rights of victims like me, in seeking truth, justice, redress, and accountability for malicious prosecution, unlawful imprisonment and wrongful convictions in violation of international law, the US Constitution and international treaties, it was by exposing my endured true story, despite of putting my life at risk, once more, and despite of being life threatened, by my assailants. And, may God help me, such exposure has become a reality!

My book first part is completed in Spanish and English and soon will be in Chinese, Russian, Portuguese, and other languages.  It’s launch is now imminent!  But, there it did not end my mission.  My book has its second part, and then follow the documentaries.  A TV Series is on the works and also TV documentaries of investigative and juridical journalism, reality tv and debates.

My clients and their families need redress and accountability.  And for that I am in relentless sought for brave and top notch attorneys to join my organization.  My selection process is quite strict, and only ethical, qualified, honest, courageous, and fighters are welcome to join us.
